The first RICS Dilapidations Forum 'Speakeasy' went ahead successfully on 25 April at the Bishop of Norwich Pub in the City of London.
A fascinating discussion on the topic of loss of rent/service charge/rates claims (which can more than double a dilapidations claim) was chaired by David Blackmore of the Forum steering group with speeches by Patrick Stell of Savills and Andrew Tugewell, a Partner at London law firm Payne Hicks Beach.
The fact that both speakers hold dual qualifications as surveyors and lawyers gave the discussion a very interesting perspective.
The discussion focussed on the applicability of case law and legal principle to the way that surveyors and lawyers handle loss of rent disputes at lease end.
A very lively debate ensued with many Forum members participating and a number of myths surrounding the often inappropriately quoted case law were well an truly put to rest, in what became a wider discussion on contentious topics that included the RICS Guidance Note on Dilapidations and the draft PLA Protocol.
Other free to attend 'Speakeasy' events around the country for Forum members are proposed for later in the year to give all members the chance to air their views and to network.
