Consultants working in the construction industry are well aware of the need to have the extent of the obligations owed to their client clearly defined in the terms of a written appointment. The same is true where collateral warranties are being provided to identified third parties but the scope of a consultant's obligations, and the parties to whom they are owed, may well not be limited to what has been expressed in writing.

This seminar will look at:

· the application of implied terms into consultant's contracts

· when a consultant may be found to owe a duty of care to
other parties involved in a project despite the absence of any contractual link
