RICS Geomatics lecture: Taking account of the 4th dimension in boundary disputes

RICS Geomatics evening lecture series recently hosted an excellent Michael Barrett award lecture by Andrew Pain Land Registry. Andrew was the winner of the 2005 award and gave a wonderful lecture on the vagaries of the world of boundary disputes.

His lecture, Taking account of the 4th dimension in boundary disputes, was very well received by the audience. Andrew has very kindly provided RICS Geomatics with a full transcript of his lecture.

We would urge every practising land surveyor and all of those involved in boundary disputes to read, what may become, a seminal document.

Lecture summary
The lecture will look at the Courts' approach to the interpretation of deeds and plans in boundary disputes including the use of extrinsic evidence, the Courts' approach to the use and interpretation of Land Registry plans including the general boundaries rule and the possible pitfalls for practitioners in relation to the Determined Boundaries procedure.

Profile
Andrew Pain MA (Durham), LLB (Lond), DPA (Lond) qualified as a Solicitor in 1974 and was appointed Land Registrar at the Plymouth local office of the Land Registry in 1988. 

He is the author of Adverse Possession: A Conveyancers Guide and co-author of Interests in Land: A Practical Guide to their effective protection at the Land Registry.  Andrew is a Contributor and a Consulting Editor to the Encyclopaedia of Forms and Precedents, and lectures widely on aspects of property law.
