Earl Cadogan and another v Sportelli and another CA ([2007] EWCA Civ 1042, 25 October 2007) upheld LT decision (LRA/50/2005, 15 September 2006) which determined that deferment rates of 4.75% should apply to houses and 5% to flats and hope value should be excluded in collective enfranchisement decisions.
