The Bribery Act 2010 introduces a corporate criminal offence of failing to prevent bribery. It also brings existing laws on bribery together. It came into force on 1 July 2011.

The act introduces additional jurisdictional powers that cover not just UK commercial organisations and individuals normally resident in the UK but also any commercial organisation that carries on a business in the UK.

These are significant changes. We have teamed up with Field Fisher Waterhouse LLP to produce guidance for members (individuals and firms) who may be affected. It can be downloaded at the foot of this page.

Referral fees or 'commission payments'

We provide guidance to UK members to help them determine how best to deal with referral fees or ‘commission payments’ and issues concerning bribery. The watchword is transparency. Members must be entirely transparent with both clients and potential clients so that they are fully aware of all referral fees which you may be offering and/or receiving through your interactions with them.

Read the referral fees guidance notes below to ensure you are compliant.
