The Panel heard the case against Mr Thomas and his firm, Rees Thomas. They were charged with failing to act with integrity and to avoid any actions or situations that were inconsistent with their professional obligations (Rule 3 of the Rules of Conduct for Members/Firms 2007) in respect of complaints about the Firm.
The Firm was also charged with failure to provide the level of service promised to its clients (Rule 5 of the Rules of Conduct for Firms 2007); to operate a complaints handling procedure (Rule 7 Rules of Conduct for Firms 2007); and to co-operate effectively with the Ombudsman Services: Property in respect of complaints or to implement final decisions of the Ombudsman.
The Panel ordered expulsion from membership of RICS and the removal of the Firm’s registration for regulation. The Panel also ordered Mr Thomas and/or the firm to pay RICS’ prosecution costs.
