RICS is required to publish certain information relating to Disciplinary and Regulatory decisions in accordance with RICS Sanctions Policy and Supplements – which can be viewed here.

RICS publishes the notices for forthcoming Regulatory Tribunal hearings approximately 14 days prior to the hearing date, and these can be viewed here.

Length of publication of Decisions/Outcome

The RICS Sanctions Policy and Supplements specify that decisions/outcomes will be published for the following periods (unless otherwise ordered by the decision maker):

Reprimand and/or undertakings and/or fines

Conditions imposed

The period during which the conditions are in force or 5 years whichever is longer

Disciplinary expulsion or de-registration (under Regulatory Tribunal Rules)

Head of Regulation suspension or de-registration of Firms (under Rules for the Registration of Firms)

The period the suspension is in place or for 12 months following de-registration.

Interim Measures (temporary suspension or restrictions on practice)

The duration of the period of suspension/ restriction on practice

Successful/unsuccessful application for re-admission to membership

Minimum of 10 years from the date of the expulsion decision or 12 months from the decision of the Registration Panel, whichever is later

Information relating to Regulatory Compliance Orders

RICS publishes the number of Regulatory Compliance Orders issued during the previous quarter, including the subject matter of the Orders.  This information will remain on the website for 12 months.

Information relating to Fixed Penalties

RICS publishes the number of Fixed Penalties issued during the previous quarter, where they relate to breaches of the Rules of Conduct (in respect of failures to provide information to RICS and failing to adhere to CPD requirements) and breaches in terms of fees required under the Rules for the Registration of Firms. This information will remain on the website for 12 months.

Information relating to Fixed Penalties (second breaches)

RICS publishes the names of Regulated Members issued with a subsequent Fixed Penalty for a second breach of Rules of Conduct (relating to CPD). This information will remain on the website for 12 months.  This information can be found below (table coming soon).
