A tour around the issues relating to Causation and the requirements to adequately connect cause to effect and to liability when making a claim.

Under a construction contract and in principle, the Contractor is responsible and liable for everything.  In return for payment of a contract sum, the Contractor is to muster all labour, plant, materials and specialists, to allow him to construct the project on time.  If something changes he remains liable, until he makes a claim and proves otherwise.

This presentation explores the requirements for a Contractor to demonstrate Causation and explores the links between the principles of effect, cause and liability.  The presentation also spotlights issues and difficulties common to many claims in the region and makes recommendations to the parties on how better to manage the claim process to avoid dispute.

  • What is effect, cause and liability and why it is important.
  • Explore some of the Contractor’s evidential requirements in demonstrating the entitlement.
  • Explore obligations on the Employer to review claims and make determinations.
  • Highlight some issues and areas that frequently have the potential to crystallise into disputes.

Meet the speaker

Andrew Woodward is a Chartered Civil Engineer with a contracting background drawn from the delivery of complex civil engineering and infrastructure projects. Based in Qatar, Andrew brings his detailed construction experience to the wider GCC region helping parties with matters of dispute surrounding the difficult issues of quantum and delay.
