Under a construction contract and in principle, the Contractor is responsible and liable for everything. In return for payment of a contract sum, the Contractor is to muster all labour, plant, materials and specialists, to allow him to construct the project on time. If something changes he remains liable, until he makes a claim and proves otherwise.
This presentation explores the requirements for a Contractor to demonstrate Causation and explores the links between the principles of effect, cause and liability. The presentation also spotlights issues and difficulties common to many claims in the region and makes recommendations to the parties on how better to manage the claim process to avoid dispute.
