Please note: The first edition of RICS’ Surveyors acting as party representatives and/or advisers is currently under development.

Surveyors acting as party representatives and advisers play a vital role in helping clients avoid, manage and resolve disputes. Their work can range from providing strategic advice behind the scenes, facilitating negotiations and helping draft contract provisions to representing clients in proceedings before courts, tribunals or other forms of dispute resolution. They may also advise clients on practical measures to minimise the risk of future disputes.

Recognising the importance of these roles, and the challenges many professionals face in gaining experience within the dispute resolution sector, RICS is developing a new global professional standard, Surveyors acting as party representatives and/or advisers. The standard will be supported by accompanying practice guidance.

Together, these documents will establish a clear framework for RICS members who advise or represent clients and employers in the avoidance, management and resolution of disputes. The professional standard will set out the mandatory requirements that apply to all RICS members globally, while the supporting guidance will provide practical recommendations, examples and additional context to help members apply the requirements in practice.

Although the practice guidance will apply to RICS members in England and Wales, many of the descriptions of good practice set out within it are universal and will support RICS members in their training and practice outside this jurisdiction.

FAQs

RICS is addressing the risks associated with advising and representing parties involved in dispute resolution proceedings by improving members’ understanding of the different processes available. This will help in navigating the complexities of alternative dispute resolution processes and in operating within a formal procedural context. In this way, members will be better able to advise and represent clients appropriately and effectively.

These documents will also be of benefit to trainee engineers, architects, claims managers, project managers, facilities managers, construction specialists and many others.
