Overview

This session will be presented by Nick Sunderland, Director and Co-Founder of Sunderland Ives. Nick has over 25 years advising clients on dispute resolution and specific experience in dealing with disputes and negotiating contracts based on the NEC 4 form. He is well versed on the problems that can arise in the administration of this form of contract, which can all be prevented with effective contract administration and negotiation. Nick will call on his experience and will present a series of common NEC 4 problems and how to resolve them.

The typical problems that will be covered in this session are:

  • Working in a spirit of mutual trust and co-operation – does this have any contractual teeth?
  • How should early warning meetings be conducted?
  • Who owns the float and time related risk allowances under NEC?
  • How to deal with compensation events that were not notified correctly.
  • Who is liable for design errors, the contractor, designer or project manager?
  • What can be counted as a Disallowed Cost?
  • If an all risks insurance policy is in the joint names, can the Employer sue the Contractor for any loss that is not paid by the insurer?
