Overview

Highly practical and intensive, this Mediation training programme will prepare you to mediate the most complex disputes to the highest standards across land, property, construction and infrastructure. This course embraces the facilitative and evaluative approaches to mediation. Our expert trainers will provide you with in-depth, practical coaching and you will receive feedback from both your trainer and your peers. This course combines the ACRE and Evaluative mediation training to provide you with one comprehensive programme.

7th July: Module 1 - Introduction to mediation and mediation advocacy: RICS approach to facilitative and evaluative mediation, theoretical background, contractual issues and mediation ground rules

8th July: Module 1 - Introduction to mediation and mediation advocacy: Preparation, opening and exploration – focus on essential soft skills

9th July: Module 1 - Introduction to mediation and mediation advocacy: Negotiation, closing and expressing an opinion or making a proposal based on your experience and expertise – focus on essential hard skills and conciliation rule

10th July: Module 2 - Practical evaluative mediation skills: Extended practical role play exercises designed to consolidate the skills learned in module 1

11th July: Module 2 - Practical evaluative mediation skills: Time-restricted mediation role plays and assessment role plays

Executive Director, Dispute Resolution Service, RICS

Dr. John Fletcher is the Executive Director of the Royal Institution of Chartered Surveyors' (RICS) Dispute Resolution Service (DRS), where he leads the development and delivery of a wide range of alternative dispute resolution (ADR) services, including arbitration, adjudication, dispute boards, mediation, expert witnesses, and conflict avoidance. Under his leadership, DRS has expanded its offerings both in the UK and internationally, providing training, accreditation, panel membership, administration, and dispute resolution consultancy services tailored to the needs of global industries. Born in South Africa, John earned his BCom LLB degree from Rhodes University before going on to complete his MPhil and PhD in Administrative Law at Cambridge University. After returning to South Africa, he practiced as a barrister at the Johannesburg Bar for ten years, focusing on civil and commercial law with a particular emphasis on constitutional matters. John's contributions to dispute resolution extend beyond his role at RICS. He was previously the Projects Director for the ADR Group, where he spearheaded international joint ventures in regions including South Africa, Europe, Brazil, the Caribbean, and other emerging markets. He also developed the ADR Group's UK workplace mediation service and led mediation training initiatives within UK universities. At RICS, John has been instrumental in the creation of the Conflict Avoidance Coalition, an initiative that is gaining rapid momentum in the infrastructure and construction industries. This coalition is dedicated to fostering collaborative solutions to disputes before they arise, providing proactive measures to reduce the risk of conflict in large-scale projects. Throughout his career, John has been a passionate advocate for the value of conflict avoidance and the transformative potential of effective dispute resolution and continues to make significant contributions to the field on both a national and international scale.

Raj Sohal joined RICS after graduating from her LLB studies at Coventry University. Raj is also an RICS Accredited Mediator and has undertaken some community mediations with MATA in Leamington. Raj facilitates the mediation training programmes, providing coaching and feedback. Raj has been at the Royal Institution of Chartered Surveyors (RICS) Dispute Resolution Service for 34 years, with the past 15 years specifically on the global development of all forms of dispute resolution in new international regions that are embracing and growing dispute resolution mechanisms. Since the inception of the DRS education department, Raj has collaborated with working parties to establish the suite of DR qualifications that we hold for Arbitration, Adjudication, Expert Witness, Mediation, Expert Determination, Party Representation and more recently conflict avoidance. This has included inputting into RICS Guidance Notes, training materials and toolkits that underpin a number of our training products. RICS is renowned for setting high professional standards and qualifications, upholding professionalism and best practice across the built environment. Raj also has a wealth of experience in appointments, panel administration, complaints and governance. Raj now heads the teams that develop and deliver ADR training and education products within RICS globally. Raj also works closely with the World Regional offices of RICS, exploring ADR opportunities and the growth of dispute avoidance and resolution globally.
