The presence of combustible cladding on a neighbour's property

RICS members & firms will be aware of the issues of combustible cladding post Grenfell.

It has been suggested, as a result of a recent legal case and commentary, that a legal liability in nuisance could be created by a neighbouring building with known ACM combustible cladding. To understand the issue, RICS sought an opinion from a leading QC in commercial property law. RICS does not provide legal advice to RICS Members and Firms. However, with his permission, Mr Fetherstonhaugh QC’s opinion on this issue is attached in full for information.
