This is a CPD session on the JCT suite of contracts, with a primary focus on some tricky pitfalls a quantity surveyor or project manager may encounter while administering the contract. The presenter is Nick Sunderland, Director and Co-Founder of Sunderland Ives, who has worked in dispute resolution in the construction industry for more than 25 years. The problems to be covered have been hand-picked based on the speaker’s own experience, including in representing clients in adjudication on such matters. 

Topics covered include contractor omissions from scope, delays due to insolvency, joint names all risk insurance, written instructions for variations, liquidated damages as a penalty, effective delay notices for loss and expense claims, descoping by variation, and termination due to non-payment. 

This promises to be an example-based, real-world situation-filled session, with problems examined against the provisions of both JCT 2016 and JCT 2024 as well as all recent case law.
