Overview

This webinar takes a straightforward look at how DBs function in various parts of the world and what those experiences tell us about the ways in which they add value to projects. This conversational discussion will touch on the practical realities of setting up DBs and the challenges that often arise once projects are underway.

Speakers will draw on situations where DBs have supported parties in resolving issues before they escalate, as well as examples where the process hasn’t been as effective, highlighting the reasons behind this. The session will also consider what other approaches are available and which may be better suited to the needs of a project, especially where the dynamics, constraints or culture make DBs harder to implement. Attendees will come away with a clearer sense of what helps DBs succeed, what can get in the way, and how lessons learned can help improve outcomes in future projects. The aim is to offer a practical and open conversation based on real experience.

Matt is a highly experienced dispute resolver and has been appointed in over 1000 disputes as adjudicator, arbitrator, mediator, expert determiner, and as a member of conflict and dispute avoidance panels and boards. Before becoming a full-time dispute resolver, Matt began his career in quantity surveying and contract management before undertaking his legal training and being called to the Bar of England & Wales in 2001. His appointments have involved complex technical and legal issues in disputes worth up to £110 million both in the UK and internationally, across sectors such as energy and process engineering, transport, infrastructure, hospitals, education, housing, and hotels and leisure. Alongside his professional practice, Matt contributes to the development of dispute resolution through teaching and examining. He is also a part-time PhD student at Queen Mary University of London, undertaking research into international law and arbitration and, in 2024 he co-authored his first book, “Adjudicating Construction and Engineering Disputes”. Matt is the current Master of the Worshipful Company of Arbitrators for 2025-2026.

Duncan is now counsel to the leading and nationally recognized construction law firm that he founded, Glaholt Bowles LLP. Duncan has practiced construction law since his call to the Bar of Ontario in 1979, resolving a wide range of disputes in the energy, infrastructure and resource industries. Since 2019 Duncan has devoted his full time to the mediation and arbitration of construction disputes. He has mediated disputes in every sector of the construction economy. He has chaired arbitration, dispute review, dispute adjudication, and combined dispute boards.
