Conflict-driven disruption increasingly affects supply chains, labour and material prices, logistics, and regulatory compliance, placing pressure on parties to assess whether contractual performance may be suspended, delayed, or excused under force majeure and related provisions.
The session brings together construction dispute and contract specialists to examine how force majeure clauses operate in conflict-affected environments, with a particular focus on FIDIC and NEC forms, and a comparative reference to other standard contract forms, such as JCT. It will consider how courts and arbitral tribunals have interpreted force majeure and exceptional events, highlight common drafting and procedural pitfalls, and set out practical steps that employers, contractors, consultants, and project stakeholders should be taking now to protect their contractual positions, preserve entitlements, and mitigate dispute risk.
