Case of Mrs Nicola Horner MRICS [5026268]

The formal charges against Mrs Nicola Horner are that:

1. On one or more occasions in May 2017 she copied, downloaded or transferred confidential data belonging to X and / or clients of X, and retained the said data in her personal control after leaving X, and her actions were:

a) In breach of her professional obligations,

b) In breach of confidentiality

c) Dishonest in that:

i. She knew she was not allowed to copy, download, transfer or retain confidential data, and / or
ii. She intended to use the confidential data to obtain a commercial advantage or allow her employer to obtain a commercial advantage,

d) In the alternative to 1 c) above, lack of integrity in that she was reckless as to the appropriateness or otherwise of copying, downloading, transferring or retaining confidential data.

Contrary to Rule 3 of the Rules of Conduct for Members 2007. Mrs Horner is therefore liable to disciplinary action under RICS Bye-law 5.2.2(c)

2. Following a letter sent on behalf of X dated 11 July 2017, in which she was asked to account for every item of confidential information taken from X, she did not disclose details of all the confidential information taken during May 2017, and her actions were:

a) In breach of her professional obligations,

b) Dishonest in that:

i. She knew she had taken further confidential information not yet known to X and she attempted to hide this from X, and / or
ii. She knew the representations made on her behalf, which represented and / or implied that no other confidential information had been taken, were untrue or misleading,

3. In the alternative to 2 b) above, lacked integrity in that her conduct demonstrated a lack of openness and / or cooperation when X were attempting to discover what confidential information had been copied, downloaded, transferred or retained.

Contrary to Rule 3 of the Rules of Conduct for Members 2007. Mrs Horner is therefore liable to disciplinary action under RICS Bye-law 5.2.2(c)
