Alternative Dispute Resolution (ADR) covers a wide range of techniques and process designed to enable parties resolve their disputes with the help of a third party. This can include formal processes such as expert determination and less formal processes such as mediation.

Mediation

Mediation is a process for resolving disputes between two parties where a neutral mediator helps them to engage in constructive dialogue with the aim of achieving a jointly acceptable resolution of issues in conflict. Mediation has proven to be highly successful and is recognised as being significantly quicker and more cost-effective than litigation. It is also less formal than court and the process is normally confidential.

A mediator appointed under this service will normally be an impartial professional (chartered surveyor, lawyer, engineer) who is trained in mediation skills and procedure.

Expert Determination

Expert determination is a procedure where parties to a dispute appoint an independent, neutral expert to determine issues in dispute. This confidential form of dispute resolution enables parties to agree a timetable with the expert who will be a person with specialist or technical knowledge relevant to the dispute.
