The Disciplinary Panel considered 10 charges against David Gurl including:

  • Three charges in 2014 of failing to carry out professional work with expedition and with proper regard for expected standards of service and customer care, contrary to Rule 5 of the rules of Conduct for Members 2007
  • Five charges in 2014 of failing to act at all times with integrity and/or in accordance with your professional obligations, contrary to Rule 3 of the Rules of Conduct for Members
  • One charge of failing to provide the information that was reasonably requested in RICS’ e-mailed letter of 19 June 2014, contrary to Rule 8 of the Rules of Conduct for Firms 2007
  • One charge of failing to co-operate fully with RICS staff, contrary to Rule 9 of the Rules of Conduct for Members 2007

The Disciplinary Panel considered six charges against DAG Property Consultancy including:

  • Two charges of failing to operate a complaints handling procedure (CHP), contrary to Rule 7 of the Rules of Conduct for Firms 2007
  • Two charges of failing at all times to act with integrity and/or avoid any actions or situations which were inconsistent with its professional obligations, contrary to Rule 3 of the Rules of Conduct for Firms 2007
  • One charge of failing to ensure that all of its previous and current work is covered by adequate and appropriate professional indemnity insurance cover, contrary to Rule 9 of the Rules of Conduct for Firms 2007
  • One charge of failing at all times to act with integrity and/or avoid any actions or situations which were inconsistent with its professional obligations, contrary to Rule 3 of the Rules of Conduct for Firms 2007

Finding: Proven against David Gurl / Proven against DAG Property Consultancy

Sanction

David Gurl: Expelled

DAG Property Consultancy: Deregistered

The Disciplinary Panel also made an order to costs.
