The Land Registry Act 2002 created a new regime which affects dealing with adverse possession.
A claim for adverse possession can thus either be made under the old or the new regime and this will depend on whether land is registered, unregistered and whether it can be shown that there was at least 12 years’ adverse possession before 13 October 2003.
